About These Terms
These terms apply to each order placed by the Consumer through the Website. The Business makes these terms available in Arabic and in any other language displayed on the Website before the Consumer places an order. If there is an inconsistency, the Arabic version applies to the extent required by applicable law.
The Business's identity and customer-service contact details are set out in the Business Contact. The Consumer may use the Business Contact for questions, cancellation, returns, complaints and after-sales support.
Orders and Contract Formation
The Website displays the main characteristics of products, the total price, applicable taxes, delivery charges, payment method, delivery arrangements and these terms before checkout. The Consumer must check the order and provide accurate information before submitting it.
Submitting an order is an offer to buy the selected products. The Business may accept the offer by sending an order confirmation or by dispatching the products, whichever occurs first. An automated acknowledgement of receipt is not acceptance. The Business will provide the Consumer with a durable record of the order confirmation and these terms.
The Business sells through the Website in the Territory, subject to product availability and any lawful delivery restrictions disclosed before checkout.
Price, Payment and Invoice
The price displayed at checkout is in UAE dirhams unless the Website clearly states otherwise, includes VAT and other mandatory taxes, and separately identifies any delivery charge before the Consumer submits the order. The Business will not charge more than the total displayed at checkout without the Consumer's express agreement.
Payment is due using the method selected at checkout. The Business may authorise or take payment when the order is submitted or when it is accepted, as clearly shown at checkout. The Business will issue an invoice or other proof of purchase containing the information required by applicable law.
Delivery, Risk and Title
The Business will deliver the products to the delivery address confirmed in the order within the Delivery Period or, if no period is stated, within the time required by applicable law. The Business will notify the Consumer if delivery is materially delayed and the Consumer may exercise any remedy available under applicable law.
Risk in physical products passes to the Consumer when the Consumer, or a person identified by the Consumer other than the carrier, takes physical possession. Title passes when the Business has received full payment, subject to the Consumer's mandatory rights.
Cancellation, Returns and Refunds
In addition to any mandatory right under the UAE consumer protection law, the Consumer may cancel an order without giving a reason within the Cancellation Period after receiving the products, or after the contract is made for a service or digital content where applicable. To cancel, the Consumer must send a clear statement through the Business Contact or the cancellation route on the Website.
After cancellation, the Consumer must return the products without undue delay, following the reasonable return instructions supplied by the Business. The Consumer must take reasonable care of the products while they are in the Consumer's possession. The Business bears return costs where the products are faulty, misdescribed, not supplied as agreed, or where applicable law requires it; otherwise, the Consumer bears the direct return cost if this was clearly disclosed before checkout.
The Business will refund sums properly due following cancellation within the Refund Period and by the original payment method unless the Consumer agrees otherwise. The Business may make a deduction only where and to the extent permitted by applicable law, including for a reduction in value caused by handling beyond what is reasonably necessary to inspect the products. Cancellation rights do not apply to products or digital content only where an exception is permitted by applicable law and was clearly disclosed before the Consumer placed the order.
Faulty Goods and Consumer Remedies
The Business will supply products that conform to their description, are of satisfactory quality, are fit for any purpose made known to the Business where applicable, and meet mandatory safety and other legal requirements. If products are faulty, unsafe, misdescribed or otherwise non-conforming, the Consumer may obtain repair, replacement, refund, compensation or another remedy available under the UAE consumer protection law. The Business will not require the Consumer to waive those rights.
Warranties and Guarantees
The Business provides the commercial warranty described with the product for the Warranty Period. It is additional to, and does not replace, limit or delay the Consumer's statutory rights. The Business will state the warranty terms, claim method, exclusions and any authorised repair arrangements clearly before purchase and in the warranty record.
Product Safety and Recalls
The Business will take reasonable steps to ensure that products supplied are safe and compliant with applicable law. If the Business identifies a safety issue or recall affecting a product, it will notify affected Consumers using available contact details, provide clear instructions and offer the remedy required by applicable law.
Digital Content
The Business will provide digital content or digital services substantially as described before purchase and with reasonable care and skill. The Business will provide security and functionality updates, including updates needed to keep the digital content conforming, for the Digital Update Period or any longer period required by applicable law. The Consumer must install updates supplied with reasonable notice where failure to do so causes the issue, provided the Business has clearly explained the consequences. This clause does not limit mandatory consumer remedies.
Promotions and Vouchers
Promotions and vouchers are subject to the specific terms clearly displayed with them, including eligibility, use limits and the Voucher Validity Period. They have no cash value unless applicable law requires otherwise, may not be sold or transferred unless the Business states otherwise, and cannot be used with another offer unless stated. The Business will not use promotion terms to reduce a Consumer's mandatory rights.
Subscriptions and Automatic Renewal
A subscription continues for the Subscription Period and renews only where the Consumer has given clear, express consent to renewal. Before each renewal, the Business will give a clear reminder within the Renewal Notice Period stating the renewal date, charge, period and a simple cancellation route. The Consumer may cancel through the Website or the Business Contact before renewal, and cancellation takes effect at the end of the paid subscription period unless applicable law requires an earlier effect.
Personal Data
The Business processes the Consumer's personal data in accordance with its separate privacy notice made available on the Website before checkout and applicable data protection law, including Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data. The privacy notice explains the purposes, lawful basis where required, recipients, retention, transfers, Consumer rights and how to contact the Business about personal data.
Website Intellectual Property
The Business or its licensors own the intellectual property rights in the Website and its content. The Business grants the Consumer a personal, limited, non-exclusive, non-transferable and revocable right to use the Website for lawful personal shopping. The Consumer must not copy, exploit, interfere with or use the Website or its content commercially except as permitted by law or with the Business's written consent.
Business Cancellation of Orders
The Business may cancel an order before dispatch where a product is unavailable, there is an obvious pricing or product-description error, payment cannot be authorised, delivery is not possible, or the Business reasonably suspects fraud or unlawful activity. It will notify the Consumer promptly and refund all sums paid for the cancelled order without undue delay. This clause does not affect remedies available to the Consumer where cancellation results from the Business's breach or applicable law provides otherwise.
Liability
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, death or personal injury caused by negligence, and the Consumer's mandatory rights under the UAE consumer protection law. Subject to that, the Business is liable for direct loss reasonably foreseeable from its breach, but its total liability arising from an order is limited to the Liability Cap. The Business is not liable for indirect or consequential loss to the extent that exclusion is permitted by applicable law.
Complaints and Disputes
The Consumer may make a complaint through the Business Contact. The Business will acknowledge and investigate the complaint promptly and seek to resolve it fairly. Nothing prevents the Consumer from referring a complaint to the Ministry of Economy or another competent consumer-protection authority, or from using any other remedy available by law.
Changes to These Terms
The Business may change these terms for future orders by publishing the updated terms on the Website before the Consumer places an order. The version accepted at checkout applies to that order. For a subscription, the Business will give reasonable prior notice of a material change and a clear right to cancel before it takes effect where required by applicable law.
Force Majeure
Neither party is liable for delay or failure in performing its obligations, other than payment obligations, caused by events beyond its reasonable control. The affected party must notify the other promptly and use reasonable efforts to minimise the effect. If the event prevents performance for more than the Force Majeure Period, either party may terminate this agreement by written notice. This clause does not limit any mandatory consumer remedy.
General
The Consumer may not assign rights or obligations under an order without the Business's consent. The Business may transfer its rights to another business, and may transfer its obligations to another business only with the Consumer's consent or as the law otherwise allows, provided that the transfer does not reduce the Consumer's rights; it will give the Consumer reasonable notice where a transfer materially affects the Consumer.
If a court or competent authority finds a provision of these terms unlawful, invalid or unenforceable, that provision is modified to the minimum extent necessary or, if that is not possible, treated as deleted. The remaining provisions continue in effect. Any provision that conflicts with mandatory consumer law is ineffective only to the extent of the conflict.
Governing Law and Courts
These terms and each order are governed by the laws of the Emirate and the federal laws of the United Arab Emirates as they apply there. The Consumer may bring proceedings in the courts that have jurisdiction under applicable law, and nothing in these terms restricts the Consumer's right to use local courts or a competent consumer-protection authority.
